Aproximación a la formación jurídica del concepto de buque

Abstract

La navegación ha jugado un papel muy importante en la existencia de los pueblos ribereños dando lugar a normas jurídicas especiales, pudiendo afirmar que el Derecho marítimo es tan antiguo como el Derecho mismo. El buque es el vehículo con el que se realiza la navegación por ello, su posición central y la importancia capital que tiene el concepto de buque dentro del Derecho marítimo. Su formación jurídica y su consideración actual repercutirá inevitablemente en buena parte de las relaciones jurídicas que el Derecho marítimo trata de ordenar y que como señala la doctrina española, tiene por objeto el "conjunto de relaciones jurídicas que nacen en o se desarrollan con el mar".

Navigation has played a very important role in the existence of the ribereños towns giving rise special legal norms, being able to affirm that the Admiralty law is as old as the same Right. The ship is the vehicle with which navigation is made and is for that reason, the central position and the capital importance that the concept of ship within the Admiralty law has. Its legal formation and its present consideration will repel inevitably in good part of the legal relations that the Admiralty law tries to order which, as it indicates the doctrine Spanish, intends the "set of legal relations that are born in or they are developed with the sea".
