Los regentes y la presidencia de la Real Audiencia de Canarias en el siglo XVIII

Abstract

En el presente estudio se procede a analizar la evolución institucional de la figura del regente de la Real Audiencia de Canarias durante el Antiguo Régimen: creación en 1566, ámbito competencial y principales razones de su supresión. La autoridad regental desempeñó sus funciones en el tribunal desde 1566 hasta 1808, exceptuando las etapas 1589-1594 y 1629-1718, en los que actuó la Capitanía General de Canarias, siendo su primer titular en 1589 el general de La Cueva. La suprema autoridad castrense ejerció los cargos de jefe militar, gobernador y presidente de la Audiencia desplazando a los regentes. Como singularidad en la historia administrativa del archipiélago, nos centramos en el año 1718, momento en que se volvió a dotar a la Audiencia de la plaza de regente, autoridad que, por primera vez, coexistió con el capitán general el cual, por derecho propio, asumió la presidencia. Las relaciones entre ambas autoridades se caracterizaron por constantes conflictos.

This study analyses the historical changes in the figure of the Regent of the Royal Court of Justice of the Canary Islands during the early administrative period, covering its creation in 1566, its sphere of competence and the main reasons for its disappearance. The Regents performed their functions in the Court from 1566 to 1808, except for the periods 1589-1594 and 1629-1718, when the General Captaincy of the Canary Islands took over this role. The first person to hold the position of Regent, in 1589, was General de La Cueva. The highest military authority held the positions of military chief, governor and president of the Court of Justice, taking the place of the Regents. A unique moment in the administrative history of the Islands occurred in 1718, when the position of Regent was reinstated at the Court of Justice. For the first time, this figure coexisted with the General Captain, who, in his own right, assumed control as President of the Court. Relations between the two authorities were characterised by continual conflicts.
