Protección de datos personales en las investigaciones penales en la Unión Europea: interacción entre la Directiva (UE) 2016/680 y el Reglamento Europol

Abstract

Nowadays we live in an increasingly interconnected world, in which the investigation and prosecution of crimes requires the collection and analysis of a large amount of information by different authorities, as well as the exchange of data between them. In the European sphere, to develop this task requires taking into account the EU regulations on data protection, both of a general nature and applicable in specific areas, such as police and judicial cooperation in criminal matters. The aim of this article is to highlight the peculiarities of the data protection system in the framework of criminal investigations carried out in the territory of the Union in its two possible variables: on one hand, when they are carried out by national authorities and, on the other hand, when they are articulated with the participation of Europol.

En la actualidad vivimos en un mundo cada vez más interconectado, en el que la investigación y el enjuiciamiento de delitos exige la obtención y análisis de una gran cantidad de información por parte de diferentes autoridades, así como el intercambio de datos entre ellas. En la esfera europea esta labor exige tener en cuenta la normativa de la UE sobre protección de datos, tanto de carácter general, como la aplicable en ámbitos concretos, como el de la cooperación policial y judicial en materia penal. El objetivo de este artículo es poner de relieve las peculiaridades del sistema de protección de datos personales en el marco de las investigaciones penales que se desarrollan en el territorio de la Unión, tanto si se hace por organismos de los distintos Estados Miembros, como si se articula con la colaboración y participación de Europol.
