The acquisition of cultural properties by public administrations: the role of the General Administration of the State and the organic disparities between autonomous communities

Abstract

The acquisition of cultural properties for public collections (museums, archives, libraries, or foundations) is a key mechanism to increase Spanish Historical Heritage. Public administrations have to comply with the constitutional mandate established in Article 46, which refers to the enrichment of this Historical Heritage as a duty of all public powers. The Central State Administration has a key advisory body in this regard, the Board for the Qualification, Valuation and Export of Spanish Historical Heritage Properties. However, not all the autonomous administrations have similar bodies in their spheres of action. In this article we propose a study of the issue, analysing the general situation for Spain and the existing regional diversities.

La adquisición de bienes culturales con destino a las colecciones públicas (museos, archivos, bibliotecas o fundaciones) es uno de los mecanismos necesarios para acrecentar el Patrimonio Histórico Español. Las administraciones públicas tienen el deber de responder al mandato constitucional establecido en el artículo 46, que hace referencia al enriquecimiento de tal patrimonio cultural como deber de todos los poderes públicos. La Administración General del Estado cuenta con un organismo asesor clave a este respecto: la Junta de Calificación, Valoración y Exportación de Bienes del Patrimonio Histórico Español. Por su parte, no todas las administraciones autonómicas cuentan con organismos de similar naturaleza en sus ámbitos de actuación. En este artículo nos proponemos un estudio de la cuestión, analizando las diversidades regionales existentes.
