Reflexiones sobre la seguridad del tránsito viario por vertidos urbanos: un supuesto de responsabilidad objetiva y paralelismos con el art.1910 del Código Civil

Abstract

Uno de los problemas que se presenta en el desarrollo urbanístico de la ciudad de Roma fue el hacinamiento y la congestión de las insulae, lo cual afectó a numerosos parámetros del hábitat de ésta, ante la necesidad de evacuar y canalizar residuos orgánicos producidos por la actividad humana, cuestión que afectó no sólo a la salubridad sino también al tránsito de los viandantes que debían sortear la calzada para evitar daños derivados de los vertidos que se arrojaban desde los edificios, por ello en el presente trabajo nos vamos a centrar en el estudio del edicto effusis vel deiectis, cuya huella se inserta en el art. 1910 del Código Civil.

One of the problems that impact in the urban development of Rome city was overcrowding and congestion of the insulae, which affected the parameters of its habitat, given the need to evacuate and chanalize organic waste produced by human activity, an issue that affected not only salutariness but also the transit of pedestrians who had to circumvent the road to avoid damage derived from the spills that were thrown from the buildings, so in this paper we are going to focus our study in the edict effusis vel deiectis, whose imprint is inserted in sect. 1910 Spanish Civil Code.
