Acceso a la función pública y discrecionalidad técnica de los tribunales calificadores en los procesos selectivos: su control judicial

Abstract

El presente trabajo analiza la problemática que surge con la aplicación de la discrecionalidad técnica por parte de los tribunales calificadores de las oposiciones y concursos para el acceso al empleo público. En los siguientes apartados se estudiará su concepto y origen, los límites de la misma, los principios que rigen en los procesos selectivos, así como el alcance y extensión del control judicial sobre la discrecionalidad técnica de los tribunales calificadores, señalando los avances más significativos en la jurisprudencia de los últimos años.

The present work deals with the problems arising from the application of technical discretion by the examination boards of the competitions and selection procedures for access to public employment. In the sections below we will focus on the study of its concept and origin, the limitations of it, the principles that govern the selective process, as well as the scope and extent of judicial control over the technical discretion of the qualifying courts, noting the most significant progress in the jurisdiction over the last few years.
