El nuevo delito de trata de seres humanos (LO 5/2010, 22-6)

Abstract

El presente artículo aborda el análisis del nuevo delito de trata de seres humanos introducido por la LO 5/2011, de 22-6 de reforma del Código penal, la cual introduce un nuevo Título, el VII Bis, con un único artículo el 177 bis, realizando tal estudio tanto desde una perspectiva exegética, como comparativa con la Decisión Marco de la Unión Europea 2002/629/JAI, 19-7, de lucha contra la trata de seres humanos, que motiva su incorporación, así como la Directiva 2011/36/UE relativa a la prevención y lucha contra la trata de seres humanos que la sustituye.

The present article approaches the analysis of the new crime of human trafficking introduced by LO 5/2011, 6-22, of reform of the Spanish penal Code, which includes a new Title, the VII Bis, with the only article 177 bis, realizing a study not only from a exegetical perspective, but also comparative with the Framework Decision of the European Union 2002/629/JAI, 7-19, that led the incorporation of this offense to the Spanish penal Code, and with the Directive 2011/36/EU, on preventing and combating trafficking in human beings wich replaces the framework Decision.
