El doble tratamiento jurídico del vehículo que introduce el huésped en el establecimiento hotelero

Abstract

Con el presente artículo pretendemos determinar cuándo la responsabilidad que el hospedador asume por los daños producidos al vehículo del huésped se subsumen en el régimen contenido en los artículos 1783 y 1784 del Código Civil, preceptos éstos que regulan la responsabilidad del hospedador por el equipaje que el cliente introduce en el hotel, y cuándo dicha responsabilidad es la establecida en la Ley del Contrato de Aparcamiento, porque la introducción de dicho vehículo supone la celebración de un contrato de aparcamiento accesorio al contrato de hospedaje.

With the present article we try to determine when the responsibility that the host assumes for the hurts produced to the vehicle of the guest there subadd in the regime contained in the articles 1783 and 1784 of the Civil Code, rules these that regulate the responsibility of the host for the baggage that the client introduces in the hotel, and when the above mentioned responsibility is the established one in the Law of the Contract of Parking, because the introduction of the above mentioned vehicle supposes the celebration of a contract of incidental parking for the contract of accommodations.
