Los principios de la Economía Social en la Ley de Sociedades Laborales y Participadas

Abstract

La situación económica sigue afectando a los sectores sociales más vulnerables. Curiosamente, las medidas de empleo llegan hasta el ámbito estrictamente mercantil. El legislador modifica la Ley de Sociedades Laborales y habla de necesidad de adaptación a los cambios sociales. Pero es más, cómo hablar de principios de la Economía Social y entenderlo como compatibles con sociedades exponentes de las sociedades de capital. Además, aparece el tipo de sociedad participada, no sólo para las sociedades anónimas y de responsabilidad limitada, sino también para el resto de tipos sociales que cumplan todos o alguno de los reseñados principios. Este estudio pretende constatar la aproximación con carácter forzado de los Principios de la Economía Social a las sociedades de capital laborales.

The economic situation continues to affect the most vulnerable social sectors. Curiously, the employment measures reach the strictly commercial sphere. The legislator modifies the Law of Labor Societies and speaks of the need to adapt to social changes. But it is more, how to speak of principles of the Social Economy and to understand it as compatible with exponential societies of the societies of capital. In addition, it appears the type of partnership, not only for corporations and limited liability companies, but also for other social types that meet all or some of the above principles. This study tries to verify the forced approximation of the Principles of the Social Economy to labor capital societies.
