Praxis comercial y resolución de conflictos por la actividad de los ediles: de Roma a la directiva 2013/11/UE

Abstract

En el presente trabajo, nos vamos a centrar en la información y protección del consumidor, y la mediación que permite una resolución mucho más rápida de los eventuales conflictos que surjan en materia de consumo haciendo hincapié en las fuentes del Derecho romano dónde nos encontramos con la protección al consumidor realizada por los aediles curules, que eran los encargados de controlar y vigilar los mercados. Y como pervive una protección del consumidor en el derecho de la unión europea gracias al impulso que se ha producido con la promulgación de dos instrumentos aprobados por la Unión Europea, la Directiva ADR (Alternative dispute resolution) 2013/11/UE, cuya transposición realiza la ley 7/2017, y el Reglamento Nº 524/2013 ODR.

In the present paper, we are going to focus on information and consumer protection, and the mediation that allows a much faster resolution of any conflicts that arise in terms of consumption, emphasizing the sources of Roman law where we find the consumer protection by the aediles curules, which were in charge of controlling and looking out the markets. And as a consumer protection in the law of the European Union survives throughs to the impulse that has been produced with the promulgation of two instruments approved by the European Union, the ADR (Alternative dispute resolution) 2013/11 / EU Directive, to whose transposition made the law 7/2017, and Regulation No. 524/2013 ODR.
