A proteção do património cultural subaquático e a sua regulação jurídica na legislação espanhola

Abstract

Neste artigo analisa-se a proteção do património cultural subaquático na legislação espanhola. A nível nacional, não existe nenhum texto legal que o proteja de maneira específica, por isso, o legislador procurou a sua proteção através do património arqueológico, que assim aparece reconhecido na Lei 16/1985, de 25 de junho, do Património Histórico Espanhol.

In this article analyses the protection of the underwater cultural heritage in the Spanish legislation. To national level, it does not exist any legal text that protect it on a specific way, therefore the legislator looked for his protection through the archaeologic heritage that appears collected in the Law 16/1985, of 25 of June, of the Spanish Historical Heritage.
