Justicia restaurativa, mediación penal y principio de oportunidad

Abstract

Este trabajo pretende dar una visión general de la Justicia restaurativa que ha tenido su origen y hasta ahora su desarrollo más extenso en países vinculados al Common Law. Nos hemos centrado en la Mediación penal, por ser el instrumento restaurativo que ha tenido un mayor desarrollo. En Europa, algunos ordenamientos jurídicos han introducido progresivamente elementos restaurativos en la Justicia Penal, partiendo principalmente del reconocimiento del principio de oportunidad. En España, las últimas Reformas operadas en el ámbito del Derecho Penal y Procesal Penal han otorgado carta de naturaleza a las prácticas de Justicia restaurativa. This work aims to give a general vision of Restorative Justice that has had its origin and until now its more extensive development in countries linked to Common Law. We have focused on criminal mediation, because it is the restorative instrument that has had a greater development. In Europe, some legal systems have progressively introduced restorative elements in Criminal Justice, starting from the recognition of the principle of opportunity. In Spain, the latest reforms in the area of Criminal Law and Criminal Procedure have granted a nature charter to Restorative Justice Practices.
