El artículo 1317 del Código Civil: ¿Un instrumento exclusivo de los acreedores consorciales?

Abstract

El otorgamiento de capitulaciones matrimoniales por los cónyuges con el propósito de sustituir el régimen de la sociedad de gananciales por el de separación de bienes, puede perjudicar a los derechos adquiridos por los acreedores con anterioridad. Este trabajo analiza la aplicación del artículo 1317 del Código Civil a la problemática anterior, con particular atención a la situación de los créditos que ostenten los acreedores privativos de uno de los cónyuges

The granting of matrimonial capitulations by the spouses with the purpose of replacing the regime of the society of gananciales by the one of separation of goods, can harm the rights acquired by the creditors previously. This work analyzes the application of article 1,317 of the Civil Code to the previous problematic, with particular attention to the situation of the private creditors of one of the spouses.
