Principio de unidad de explotación y su incidencia en viviendas turísticas. El uso mixto de complejos extra hoteleros

Abstract

En el presente informe centramos nuestra atención en los principios recogidos por la normativa autonómica para priorizar la explotación profesional del servicio de alojamiento: el principio de unidad de explotación y el de exclusividad del uso turístico, con el propósito de averiguar si pueden enervarse los mismos en los complejos extrahoteleros de uso mixto. La razón es que en ellos se vienen explotando viviendas de uso turístico que, por estar hoy prohibidas al no sujetarse a tales principios, incrementan la actividad realizada como economía sumergida. De un lado, es preciso analizar el antedicho principio de unidad de explotación al que están sometidos los edificios sujetos al régimen de propiedad horizontal y las diferentes posiciones adoptadas por las instituciones y la doctrina, abordando, en particular, la eventual incompatibilidad con algunos principios comunitarios para adoptar una posición firme sobre su sostenimiento o no. De otro, analizaremos, como se señaló, la ocasional anulación de este principio en los establecimientos de uso misto para permitir la explotación de las viviendas turísticas, contribuyendo al desarrollo de esta modalidad alojativa al margen del mismo, allí donde se pueda, coadyuvando también a impulsar y fortalecer el resto de la actividad turística complementaria. Entendemos que las soluciones estatales a corto plazo centrarán sus esfuerzos en los sectores profesionales que cuentan con fuertes lobbys empresariales: esto es, el transporte, el alojamiento (hotelero y extrahotelero) y la intermediación, debiendo buscarse otras alternativas para aquella otra actividad que carece de estas vías de presión.

In this report we focus our attention on the principles included in the regional regulations to prioritize the professional exploitation of the accommodation service: the principle of unity of exploitation and the principle of exclusivity of the tourist use, with the purpose of finding out if they can be enervated in the extrahotel complexes of mixed use. The reason for this is that they have been exploiting tourist accommodation which, since they are currently prohibited as they are not subject to such principles, increase the activity carried out as a submerged economy. On the one hand, it is necessary to analyse the above-mentioned principle of unity of exploitation to which buildings subject to the horizontal property regime are subject and the different positions adopted by the institutions and the doctrine, addressing, in particular, the possible incompatibility with some Community principles in order to adopt a firm position on their support or not. On the other hand, we will analyze, as it was pointed out, the occasional annulment of this principle in the establishments of mixed use to allow the exploitation of the tourist housings, contributing to the development of this lodging modality outside the same one, where it is possible, contributing also to impel and to strengthen the rest of the complementary tourist activity. We understand that the state solutions in the short term will focus its efforts on the professional sectors that have strong business lobbies: that is, transport, accommodation (hotel and non-hotel) and intermediation, and other alternatives must be sought for that other activity that lacks these means of pressure.
