Las viviendas de uso turístico y la cuestión competencial en materia civil

Abstract

El trabajo aborda la cuestión competencial en materia civil que plantea la normativa de las Comunidades Autónomas sobre viviendas de uso turístico, pues se regulan algunos aspectos que afectan al derecho de propiedad, y otros relativos a los derechos y obligaciones que genera el contrato de alojamiento turístico. Se pretende analizar si algunos aspectos de esta normativa vulneran o no determinadas competencias atribuidas al Estado en el art.

149.1.8ª CE, concretamente, la relativa a la legislación civil y la que afecta a las bases de las obligaciones contractuales.

This paper deals the issue of competence in civil matters raised by the rules of Autonomous Communities on housing for tourist use, because these provisions regulates some aspects concerning the property right, and others aspects relating to the rights and obligations created by contract tourist accommodation. The goal is to analyze if some parts of these regulations break or not certain competences attributed to the State by art. 149.1.8ª CE, specifically the competence related to civil law and that which affects the bases of contractual obligations.
