La utilización de materiales biológicos humanos con fines diagnósticos y terapéuticos

Abstract

Los materiales biológicos humanos se utilizan en la actualidad para un gran número de fines. En este trabajo vamos a ocuparnos de aquellos que menos rechazo plantean desde un punto de vista social, pero que, sin embargo, presentan interesantes cuestiones de carácter ético y jurídico. Por un lado, diversos materiales biológicos se utilizan diariamente para la realización de análisis médicos, con la intención de evaluar la salud presente o futura del paciente. Por otra parte, algunos materiales biológicos pueden ser empleados con fines terapéuticos en el propio sujeto o en terceros, como sucede en el caso de los trasplantes de órganos y tejidos. El autor analiza la extensa legislación existente al respecto en relación con la obtención, utilización y almacenamiento de dichos materiales biológicos.

At present times human biological materials are used for a great number of purposes. In this work we are going to deal with those that raise less conflict from a social point of view, but that, nevertheless, present interesting ethical and legal issues. On the one hand, diverse biological materials are used every day to carry out medical analyses, with the intention of testing the present or future health of the patient. On the other hand, some biological materials can be used for therapeutic purposes in the own subject or in a third person. That is the case of organ and tissue transplantation. The author analyses the extensive legislation existing in this topic in relation with the obtaining, use and storage of the above mentioned biological materials.
