Fórmulas complementarias de resolución de controversias jurídico-administrativas: acerca de la creación de comisiones o tribunales administrativos

Abstract

Durante muchos años la reclamación administrativa ha tenido un valor muy pequeño para garantizar los derechos e intereses legítimos de los ciudadanos. En la actualidad, es necesario considerar y desarrollar nuevas alternativas, para, por un lado, establecer una vía administrativa eficaz, y, por otro, intentar reducir el atasco judicial que experimentan los Tribunales de Justicia. En este contexto, son ilustrativas las experiencias del Tribunal Administrativo de Navarra y del Consell Tributari del Ayuntamiento de Barcelona, que realizan una función muy importante para reducir el número de asuntos judiciales. En esta línea, es destacable, también, el Proyecto de Tribunal Administrativo de Andalucía, que se puede convertir en un órgano muy eficaz para resolver conflictos administrativos en determinadas materias.

For many years the administrative complaint has had a value too small to guarantee the rights and legitimate interests of the citizens. Nowadays, is necessary to consider and develop new alternatives, so that on the one hand, to establish an administrative authority more effective, and, on the other hand, try to reduce the judicial jam that have the Courts of Justice. In this context, the experiences are illustrative of the Administrative Tribunal of Navarre and the Tributari Council of the City Council of Barcelona, to perform a function very important to reduce the number of judicial affairs. In this line is notable, also, the Project of Administrative Tribunal of Andalusia, which can become a body very effective to settle administrative disputes in certain matters.
