Principios de aplicación en la detención internacional

Abstract

Cuando hablamos de la figura Jurídica de la Detención, lo primero que debemos que tener en cuenta, es la relación absoluta que tiene con la desobediencia a la ley. Como contrapartida a la limitación de un derecho tan fundamental, como es, la libertad, se debe garantizar unos mínimos de rigurosidad en la actuación por parte de quien detiene. Todas estas garantías deben estar amparadas por el marco normativo de los derechos fundamentales, siendo estos, el claro reflejo de los derechos humanos, que se cristalizan en las Constituciones. Debemos tener en cuenta que cuando se habla de vulneración de los derechos Fundamentales, esta intromisión siempre debe estar avalada por unos principios que son inherentes al ser humano, por el mero hecho de serlo. En el marco de esta protección entran en juego los principios que son garantes de que se cumplan rigurosamente la protección de la esfera más intima del detenido, es decir, que no se vean vulnerados derechos fundamentales, tan intrínseco a la persona, como la libertad o la dignidad.

When we talk about the legal figure of the Detention, the first thing we have to take into account, is the absolute relationship that has with disobedience to the law. As a counterpart to the limitation of such a fundamental right, as it is, freedom, must be guaranteed a minimum of rigor in the performance by the party who stops. All these guarantees must be covered by the normative framework of fundamental rights, these being the clear reflection of human rights, which are crystallized in the Constitutions. We must bear in mind that when we talk about the violation of fundamental rights, this interference must always be supported by principles that are inherent to the human being, for the mere fact of being so. Within the framework of this protection, the principles that ensure that the protection of the most intimate area of the detainee is strictly enforced, that is, that fundamental rights are not violated, as intrinsic to the person, as freedom or the dignity.
