Hacia un modelo registral Marítimo coherente: retos y reformas en torno al registro de bienes muebles en el Derecho español

Abstract

El sistema registral marítimo español mantiene una estructuradual —el Registro de Buques y Empresas Navieras (RBEN) y el Registro de Bienes Muebles (RBM)— cuya coherencia resulta cuestionable en el actual contexto normativo y tecnológico. El presente trabajo analiza críticamente el papel del RBM dentro del estatuto jurídico del buque y examina las disfunciones derivadas de su insuficiente coordinación con el RBEN, especialmente en términos de trazabilidad, seguridad jurídica y eficacia publicitaria. El estudio incorpora una comparación con modelos registrales europeos que han evolucionado hacia estructuras unitarias o duales coordinadas y valora las implicaciones de las reformas introducidas por la Ley 11/2023 y por la modernización de la Administración marítima española. Sobre esta base, se proponen diversos escenarios de convergencia —unificación, inter-operabilidad reforzada o modelo híbrido— orientados a la futura reforma de la Ley de Navegación Marítima. El trabajo concluye que la digitalización integral y la clarificación funcional de competencias permiten avanzar hacia un modelo registral inteligente, basado en un folio electrónico único y en una publicidad integrada que responda a las exigencias contemporáneas del tráfico marítimo.

The Spanish maritime registration system rests on a dual structure—the Ship and Shipping Companies Register (RBEN) and the Register of Movable Property (RBM)—whose coherence has become increasingly questionable in the current regulatory and technological context. This study offers a critical analysis of the role played by the RBM within the legal framework governing the ship’s registry and examines the dysfunctions arising from its insufficient coordination with the RBEN, particularly with regard to traceability, legal certainty and the effectiveness of registral publicity. The paper incorporates a comparative assessment of European registration models that have evolved towards unitary systems or coordinated dual structures and considers the implications of the reforms introduced by Act 11/2023 and by the recent modernisation of the Spanish Maritime Administration. Building on this analysis, the study proposes several convergence scenarios—full unification, enhanced interoperability, or a hybrid model—aimed at informing the forthcoming reform of the Maritime Navigation Act. It concludes that comprehensive digitalisation and a clearer allocation of institutional responsibilities provide a viable foundation for an intelligent registral model based on a single electronic folio and an integrated system of publicity capable of meeting the contemporary demands of maritime traffic.
