The legal battle of neuro-rights: new human rights or reinterpretation of already consolidated rights?

Abstract

While neurotechnology is significantly transforming the understanding of the human brain, the use of brain-machine interfaces, advanced neuroimaging techniques and devices that record or modify brain activity raise a number of questions about autonomy, mental privacy and legal responsibility for human actions. To this end, some propose the creation of a new category of human rights, neuro-rights, arguing that the current catalog of human rights is insufficient to contemplate cognitive autonomy and brain integrity. This study will analyze the arguments for and against and conclude whether the proliferation of new rights could cause confusion and reduce the effectiveness of already consolidated guarantees.

Mientras la neurotecnología está transformando significativamente la comprensión del cerebro humano, el uso de interfaces cerebro-máquina, técnicas avanzadas de neuroimagen y dispositivos que registran o modifican la actividad cerebral, plantean una serie de preguntas sobre la autonomía, la privacidad mental y la responsabilidad legal de las acciones humanas. Para ello, hay quienes proponen la creación de una nueva categoría de derechos humanos, los neuroderechos, argumentando que el catálogo actual de derechos humanos es insuficiente a la hora de contemplar la autonomía cognitiva y la integridad cerebral. En este estudio se analizarán los argumentos a favor y en contra y se llegará a una conclusión sobre si la proliferación de nuevos derechos podría provocar confusión y reducir la eficacia de las garantías ya consolidadas.
