La cooperativa como referente del desarrollo del ecosistema legislativo de la economía social

Abstract

La Comunidad Autónoma de Canarias tiene la base legal para trabajar en la economía social y, sin duda, no debe quedar ajena a esa necesidad. En este contexto, se examina la economía social en el ámbito territorial, aportando soluciones a problemas interpretativos del ordenamiento jurídico español. Estas soluciones resultan innovadoras, ya que contribuyen de forma positiva a una definición más precisa del concepto, especialmente considerando que el marco legislativo estatal ha comenzado un proceso de reforma, lo que implicará cambios en las normas específicas relacionadas con la economía social. Esto introduce un aspecto dentro del debate jurídico que se abre como resultado de las reformas y tiene como referente de actuación a los principios cooperativos.

The Autonomous Community of the Canary Islands has the legal basis to work in the social economy, and it should certainly not be oblivious to this need. It is within this framework that the social economy in the territory is analyzed, offering solutions to problems of interpretation of the Spanish legal system, which are novel in nature, insofar as they have a positive impact by clarifying its conceptualization, bearing in mind that the state legislative framework has begun the process of modification and, therefore, the changes in this area will affect special regulations in the social economy. This introduces an aspect into the legal debate that opens as a consequence of the reforms, using cooperative principles as a reference for action.
