La Ley Orgánica del Sistema Universitario y la innovación docente: especial referencia a la economía social

Abstract

Este trabajo pretende la exposición de una circunstancia jurídica a la que la enseñanza universitaria se ve abocada que es la innovación y la posibilidad de que dicha innovación docente verse específicamente en el tipo societario que configura el cuadro dela economía social. Dentro del ámbito del Derecho mercantil la economía social se visualiza como fórmula colectiva de organización social para lograr, mediante el esfuerzo y recursos comunes, soluciones que no se pueden lograr individualmente y es a la organización resultante, a la que le toca asumir las consecuencias positivas y negativas de los riesgos que su actuación en el ámbito económico genere. Con ello, y la legislación universitaria de pertinente aplicación, se constata que la innovación docente se convierte en contenido imprescindible en la labor de las universidades y por ende de la labor de las/os docentes, de forma que queda configurada en una estrategia fundamental de las universidades, de los centros y de las coordinaciones de las titulaciones, y ello teniendo presente que el objeto esencial del proceso educativo es enseñar y aprender sin perder de vista que esta labor debe adaptarse a los cambios sociales, económicos, tecnológicos y culturales que se desarrollan en cada momento histórico. Conla propuesta que realizamos en este trabajo, la innovación docente y los valores de la economía social, a través de la propuesta de proyecto docente que los incorpore, se está evidenciando que las universidades al transformar sus formas de aprendizaje y de enseñanza se adaptan a las demandas de unas sociedades en permanente cambio. Así, se expone i.-el marco jurídico de la economía social sin perder de vista la normativa de la Comunidad Autónoma de Canarias en este ámbito; ii.-la relación directa de la regulación del sistema universitario español y la economía social con iii.-una propuesta innovadora plasmada en el proyecto docente de la asignatura Derecho de Sociedades correspondiente al ámbito del Derecho mercantil.

This work aims to expose a legal circumstance to which university education is faced, which is innovation and the possibility that said teaching innovation can be seen specifically in the corporate type that makes up the framework of the social economy. Within the scope of commercial law, the social economy is viewed as a collective formula for social organization to achieve, through common effort and resources, solutions that cannot be achieved individually and it is the resulting organization that must assume the positive consequences. and negative aspects of the risks that their actions in the economic sphere generate. With this, and the university legislation of pertinent application, it is confirmed that teaching innovation becomes an essential content in the work of universities and therefore in the work of teachers, so that it is configured in a fundamental strategy of the universities, the centers and the coordination of the degrees, and this keeping in mind that the essential objective of the educational process is to teach and learn without losing sight of the fact that this work must adapt to the social, economic, technological and cultural changes that are taking place. develop in each historical moment. With the proposal that we make in this work,teaching innovation and the values of the social economy, through the proposal of a teaching project that incorporates them, it is becoming evident that universities, by transforming their ways of learning and teaching, adapt to the demands of societies in constant change. Thus, i.-the legal framework of the social economy is exposed without losing sight of the regulations of the Autonomous Community of the Canary Islands in this area; ii.-the direct relationship between the regulation of the Spanish university system and the social economy with iii.-an innovative proposal reflected in the teaching project of the subject Company Law corresponding to the field of commercial law.
