Propuesta de traducción comentada, del inglés al español, de documentos pertenecientes al proceso judicial John C. Depp, II v. Amber Laura Heard, celebrado en el Circuit Court del condado de Fairfax, en el estado de Virginia (EE UU).

Abstract

El proceso judicial por difamación que enfrentó, durante el año 2022, a los actores Johnny Depp y Amber Heard en los tribunales civiles del estado de Virginia, en Estados Unidos, ha sido cubierto internacionalmente por los medios de comunicación. Debido al interés que suscita este litigio en la actualidad, hemos seleccionado, para este Trabajo Final de Máster, tres documentos jurídicos pertenecientes al proceso judicial John C. Depp v. Amber Laura Heard para ofrecer nuestra propuesta de traducción comentada sobre ellos, del inglés al español. En concreto, hemos analizado y traducido una demanda, una contrademanda y una sentencia. Para ello, hemos abarcado, en las consideraciones teóricas iniciales, los dos ámbitos temáticos principales de nuestros textos (la difamación y la violencia de género), así como hemos descrito, en detalle, su situación comunicativa. Asimismo, hemos expuesto las características esenciales de los lenguajes jurídicos en inglés y en español, y los problemas más habituales que surgen al traducirlos, además de describir en profundidad la herramienta que hemos empleado para elaborar la propuesta de traducción: la taxonomía de técnicas para la traducción jurídica elaborada por Orozco Jutorán (2014). Por último, hemos descrito el encargo de traducción simulado que hemos planteado para este proyecto. Tras finalizar el capítulo teórico, presentamos nuestra propuesta de traducción, acompañada de un comentario argumentado sobre los problemas de traducción que surgieron en torno a los ámbitos ortotipográfico, terminológico y estilístico, y las soluciones que hemos implementado para solventarlos. Finalmente, en el capítulo de las conclusiones, se exponen los resultados más significativos de esta investigación.

In 2022, the defamation lawsuit that brought actors Johnny Depp and Amber Heard before the civil courts of the State of Virginia, in the United States, was internationally covered by the media. Due to the interest that this matter of concern has nowadays, we have selected, for this Master’s Degree Final Project, three legal documents belonging to the John C. Depp v. Amber Laura Heard case, in order to offer an annotated translation proposal of them, from English into Spanish. Specifically, we have worked with a complaint, a counterclaim and a judgment order. As an initial theoretical framework, we have discussed the two main thematic fields of our source texts (defamation and domestic violence), as well as we have described, in detail, their communicative contexts. In addition, we have also outlined the most important features of both English and Spanish legal languages, and identified the main problems that may arise when translating them, in parallel with an in depth description of the tool we have applied to produce our translation proposal: the legal translation taxonomy of techniques developed by Orozco Jutorán (2014). Finally, we have described the circumstances of the simulated translation brief submitted for this project. Our translation proposal is the focus of the third chapter, and it is supported by an informed discussion about the translation problems regarding the orthotypographic, terminological and stylistic domains, along with the corresponding solutions that we have adopted to overcome them. Lastly, in the concluding chapter, we have summarized the most relevant results from this research.
