El derecho a la libertad de circulación (interna) de quienes migran irregularmente

Abstract

En este artículo se analiza el sentido y alcance que tiene uno de los derechos reconocidos en el Pacto Internacional de Derechos Civiles y Políticos: el derecho a la libertad de circulación en su vertiente interna (al interior de las fronteras de un Estado) tal y como lo interpreta el órgano garante de su cumplimiento (el Comité de Derechos Humanos). El objetivo es determinar en qué medida las personas migrantes en situación irregular tienen (o deberían tener) derecho a su disfrute.

This article analyzes the meaning and scope of one of the rights recognized in the International Covenant on Civil and Political Rights: the right to liberty of movement in its internal aspect (within the borders of a State) as it is interpreted by the Human Rights Committee. The purpose is to determine to what extent migrants in an irregular situation have (or ought to have) the right to their enjoyment.
