¿Tolerancia o libertad religiosa?: cooperación y adaptación razonables

Abstract

El ensayo revisa los obstáculos que han dificultado la implantación de la LOLR de 1980, así como las amenazas actuales a la libertad de pensamiento, conciencia y religión. El laicismo distorsiona el modelo que se diseñó en 1978, y que se volvió a proclamar en 1980, y es incompatible con las obligaciones en relación a la libertad religiosa y de culto impuestas a los poderes públicos por la CE 78 y por la LOLR, así como por los tratados internacionales en materia de protección de derechos humanos ratificados por España. La no confesionalidad del Estado (art. 78) significa distanciamiento respetuoso frente a las religiones, así como cooperación y adaptación razonables.

The essay reviews the obstacles that have hindered the implementation of the 1980 LOLR, as well as the current threats to freedom of thought, conscience and religion. Secularism distorts the model that was designed in 1978 and proclaimed again in 1980, and is incompatible with the obligations in relation to freedom of religion and worship imposed on public authorities by the CE 78 and the LOLR, as well as by the international treaties on the protection of human rights ratified by Spain. Non-confessionalism of the State (art. 16.3 CE 78) means respectful distancing from religions, as well as reasonable cooperation and accommodation.
