La articulación de la autonomía local de islas y municipios en el ámbito material de la ordenación del territorio y urbanismo

Abstract

La Tesis Doctoral “LA ARTICULACION DE LA AUTONOMIA LOCAL DE ISLAS Y MUNICIPIOS EN EL AMBITO MATERIAL DE LA ORDENACION DEL TERRITORIO Y EL URBANISMO” propuesta, tiene por objeto realizar una aproximación acerca de cuál sea el alcance y significado del concepto de autonomía local conforme al contenido asignado por la legislación del Estado y de las Comunidades Autónomas, en el marco de la garantía constitucional de la institución, en el concreto ámbito material de la ordenación del Territorio y Urbanismo, pero también su articulación en el binomio Islas-Municipios con la propia CCAA y todo ello en el contexto sociopolítico, económico y jurídico del Archipiélago canario. El objetivo pretendido se ha centrado pues, en la compleja articulación de las relaciones entre las distintas entidades públicas territoriales titulares de intereses en los ámbitos materiales definidos, en un intento de clarificar cuál ha de ser el papel que las distintas entidades territoriales deben desempeñar; analizar la fórmula más adecuada para la acción de gobierno y administración de cada una de las Administraciones públicas implicadas teniendo en cuenta que dicha acción ha de articularse desde el papel que la Constitución y el llamado “bloque de la constitucionalidad” ha fijado para cada una de ellas. Tras casi treinta años de desarrollo de un determinado modelo, asistimos además en nuestro contexto más inmediato a un proceso de cambio legislativo en la política urbanística de Canarias que no sólo ha sacudido los pilares de la estructura político-administrativa inspirado en los axiomas de la simplificación administrativa y de los principios de responsabilidad y subsidiariedad, sino que pretende ir más allá, alterando el concepto y entendimiento del “Territorio” y de la propia “ciudad”.

The Doctoral Thesis "THE ARTICULATION OF THE LOCAL AUTONOMY OF ISLANDS AND MUNICIPALITIES IN THE MATERIAL AREA OF THE ORGANIZATION OF THE TERRITORY AND THE URBAN PLANNING" proposal, aims to make an approximation about what is the scope and meaning of the concept of local autonomy according to the content assigned by the legislation of the State and the Autonomous Communities, within the framework of the constitutional guarantee of the institution, in the concrete material scope of the planning of the Territory and Urbanism, but also its articulation in the binomial Islands-Municipalities with the own CCAA and all this in the socio-political, economic and legal context of the Canarian Archipelago. The intended objective has been focused, then, on the complex articulation of relations between the different territorial public entities holding interests in the defined material areas, in an attempt to clarify what the role that the different territorial entities should play must be; analyze the most appropriate formula for government action and administration of each of the public administrations involved, taking into account that such action must be articulated from the role that the Constitution and the so-called "constitutionality block" have set for each of they. After almost thirty years of development of a certain model, we also witness in our immediate context a process of legislative change in the urban policy of the Canary Islands that has not only shaken the pillars of the political-administrative structure inspired by the axioms of simplification administrative and the principles of responsibility and subsidiarity, but intends to go further, altering the concept and understanding of the "Territory" and the "city" itself.
