Abstract

El presente texto es una recensión del libro de Adoración Guamán y Gabriel Moreno, dedicado a analizar las diferentes aristas socio-políticas y fundamentalmente jurídicas de la relación conflictual entre las empresas transnacionales y los derechos humanos. La obra afirma, tras un amplio repaso a las diferentes normas e instrumentos no vinculantes existentes para enmarcar la cuestión, la necesidad y la posibilidad avanzar hacia la aprobación del llamado Binding Treaty, el Instrumento Internacional Jurídicamente Vinculante sobre Empresas Transnacionales y otras empresas de negocios con respecto a los derechos humanos que está siendo negociado siguiendo el mandato de la Resolución 26/9 en el marco del Consejo de Derechos Humanos de Naciones Unidas.

The present text is a review of the book of Adoration Guamán and Gabriel Moreno. The book analyses the different socio-political and legal edges of the conflictual relationship between transnational corporations and human rights. It contains a review of the different norms and non-binding existing instruments to frame the issue and its main focus is to justify the need and the possibility to move towards the approval of the so-called Binding Treaty, the International Legally Binding Instrument on business and human rights that is being negotiated, following the mandate of Resolution 26/9, within the framework of the Human Rights Council of the United Nations.
