Los jueces de apelaciones de Canarias en el Antiguo Régimen

Abstract

Considerando que el análisis histórico de la Administración de Justicia durante el Antiguo Régimen continúa siendo relevante para los historiadores de las instituciones, se examina la dimensión histórico-jurídico institucional y social de los jueces de apelaciones de la Audiencia de Canarias en el período 1526-1800 sobre la base de fuentes documentales inéditas. Además de sacar a la luz los 87 oidores que ocuparon la plaza de asiento en el tribunal isleño, los criterios de selección, el proceso y título de nombramiento, el juramento y la toma de posesión, la remuneración, la duración del cargo, su procedencia y cursus honorum, se destacan las obligaciones y prohibiciones que contribuyeron a la configuración de un estatuto jurídico fundamental cuya finalidad es garantizar el correcto ejercicio de la función judicial.

As the historical analysis of the Administration of Justice during the Ancien Régime is relevant to institutional historians, this article examines the historical, legal, institutional, and social dimensions of the appellate judges of the Royal Audience of the Canary Islands from 1526 to 1800 based on unpublished documentary sources. In addition to identifying the 87 judges holding the position of civil servant in the island court, the study examines their selection criteria, appointment process and title, oath and inauguration, remuneration, term of office, origin, functions, and cursus honorum. It also highlights the obligations and prohibitions inherent to these royal officials, which contributed to shaping the fundamental legal statute for the exercise of their office and ensured a fair and efficient administration of justice.
